You will receive the Gift Card at the email address you provide during the purchase. Enter the email address of the person receiving the gift and choose whether to send your gift immediately or schedule a date and time of your choice. During checkout, confirm your email address in order to receive the confirmation of your order.

The Gift Card is valid for 5 years. You can use it in our official online boutique and in participating physical boutiques. You will not be able to use it in outlets, DEVs, non-participating boutiques or any other online or physical retailer. You can use the Gift Card in a single payment, integrate the amount with another payment method or choose to keep part of its value for your next purchase. You can use the remaining credit both online and in one of the authorized boutiques.

You can return the Gift Card within 15 days of purchase. You will receive a refund on the same payment method you chose when ordering.

If you wish to return an order paid partly with a Gift Card and partly with another payment method, you will receive a combined refund: the amount paid with the Gift Card will be credited back to the same; instead you will receive the remaining amount on the payment method chosen at the time of purchase.

If you intend to purchase a Gift Card and one or more of our products you will need to place two separate orders.

The Hogan gift cards sold in the United States (the “Gift Cards” and singularly, the “Gift Card”) are issued by Italiantouch USA, Inc. a New York company with an office at 555 Madison Avenue, New York, NY 10022 (the “Issuer”). By purchasing a Gift Card, the customer agrees to be bound by these terms and conditions. The Issuer reserves the right to change these terms and conditions from time to time in its discretion by posting the revised version of these terms and conditions on our U.S. website <a href="https://www.hogan.com/us-en/home/">Hogan - Official Online Shop</a>/ (the “Website”). In addition, you can call our toll-free customer service at (+1) 855-504-6426 for inquiries relating to these terms and conditions. The Gift Card shall be purchased and activated on the Website. Thereafter, the Gift Card could be used on the Website. The Gift Card can be issued up to a maximum amount of US$2,000.00 (two thousand/00 dollars). One single customer cannot purchase Gift Cards for a total value exceeding US$10,000.00 (ten thousand/00 dollars) on any one day. The Gift Card is activated by paying the amount that the customer wishes to upload on the card up to the maximum amount set forth herein. At the time of the issuance of the Gift Card, the Customer will receive a confirmation email for Gift Cards purchased online, for the amount uploaded on the Gift Card. Gift Cards may not be purchased at a discount or through a promotion of any kind, including payment by voucher or another Gift Card. By purchasing a Gift Card, you agree that it shall be for private use by you or by the recipient of the Gift Card and shall not be for any commercial use or for resale.<br /> NOTICE OF ARBITRATION: The purchase and use of the Gift Card is subject to binding arbitration of any disputes which may arise as provided in the Arbitration Agreement and Class Action Waiver set forth herein. The customer should read the Arbitration Agreement and Class Action Waiver carefully and should not use the Gift Card if the customer is unwilling to accept them.<br /><br /> <strong>Nature</strong><br /> The Gift Card is not a debit or credit card. The Gift Cards are not refundable or redeemable for cash, except when required by law; provided, however, that a Gift Card with a remaining balance of less than ten dollars ($10) can be redeemed for cash as provided by applicable law. The Gift Card has no cash value, and any balance against purchases made with a Gift Card will be made only as balance on the Gift Card, and not credited back to a credit card or other form of payment. The Gift Card should be kept with extreme care as it can be used by any person in possession of it. The Website has no obligation to verify the identity of the person using the card, and the Issuer is not responsible for unauthorized use of a digital Gift Card due to a third party obtaining purchaser’s and/or recipient’s Gift Card information (e.g., through hacking or other data breach). The Issuer expressly decline any liability concerning, by way of example and not limited to, the improper use, theft or loss of the card; these circumstances do not mean that the available credit will be replaced or refunded. Use of the Gift Card is limited to the amount of funds held on the Gift Card. The full amount of each purchase, including taxes, will be deducted from the funds held on the Gift Card. If the Gift Card holds insufficient funds to cover a purchase, the customer shall pay the difference via other payment methods accepted on the Website.<br /><br /> <strong>Use</strong><br /> The Gift Card is intended exclusively for purchases of products on the Website. The Gift Card can be used for more than one purchase until the Gift Card amount has been spent in its entirety, or as partial payment for a purchase. Any time the Gift Card is used, the relevant amount is deducted, and any remaining balance is still available for future purchases. If the balance available on the Gift Card is not enough to cover the purchase price, it can be used along with other payment methods accepted by the Website. The remaining balance can be verified at any time on the Website at https://www.hogan.com/sInk/gift-card-balance/. No activation, use or dormancy fees apply to Gift Cards.<br /><br /> <strong>Lost Stolen Gift Cards</strong><br /> Except where required by applicable law, the Issuer is not responsible for and will not replace a Gift Card if lost, stolen (including a third party fraudulently obtaining a digital Gift Card’s information), damaged or destroyed. In the event that a Gift Card fails to function properly, your sole remedy is the replacement of your Gift Card with another Gift Card with a corresponding balance to your account.<br /><br /> <strong>Misuse of the Gift Cards</strong><br /> Issuer reserves the right, in their sole discretion, to refuse to honor, void, suspend or terminate use of any Gift Card if Issuer suspects any fraud or misuse of a Gift Card. Issuer is not liable to the purchaser or the user for any improper, unauthorized or fraudulent use of his or her Gift Card by a third party. If the Issuer discovers any fraud in the purchase of Gift Cards, Issuer may cancel the affected Gift Cards and seek alternative payment for any purchase previously made with such Gift Cards. This right is in addition to any other rights and remedies Issuer may have, all of which are expressly reserved. In addition, the purchaser and user of a Gift Card agree to jointly and severally defend and indemnify Issuer, its subsidiaries and affiliates from and against any claims, expenses or liabilities made against or incurred by any of them in connection with the use of a Gift Card or violation of any of these terms and conditions or applicable laws, rules and regulations.<br /><br /> <strong>Limitation of Liability</strong><br /> Issuer and its affiliates and subsidiaries and their respective officers, directors, shareholders, employees, agents and representatives make no warranties, express or implied, with respect to gift cards, including, without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. In no event shall Issuer’s liability to the purchase of user of the gift card exceed the value of the gift card. Issuer shall have no liability for any incidental, indirect or consequential damages (including without limitation loss of profit, revenue or use) arising out of or in any way connected with these terms and conditions, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory. In no event shall Issue have any liability for unauthorized access to, or alteration, theft or destruction of a gift card through accident, misuse or fraudulent means or devices by the purchaser or holder or any third party, or as a result of any delay or mistake resulting from any circumstances beyond issuer’s control. Certain State laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions or limitations may not apply to you, and you may have additional rights.<br /><br /> <strong>Arbitration Agreement</strong><br /> By accepting the terms and conditions, or using the Gift Card, customer and Issuer agree to submit any and all Disputes (as defined below) to binding arbitration pursuant to the Federal Arbitration Act, which shall govern the interpretation and enforcement of this arbitration agreement (the “Arbitration Agreement”). Arbitration shall be before JAMS (www.jamsadr.com). The arbitration shall be conducted before a single arbitrator. The arbitration shall in no event be commenced as a representative or class arbitration. For arbitration before JAMS, the JAMS Comprehensive Arbitration Rules & Procedures and the JAMS Recommended Arbitration Discovery Protocols for Domestic, Commercial Cases will apply. The arbitration shall be brought in New York, NY. Customer and Issuer understand that by agreeing to such binding arbitration they are hereby waiving, to the fullest extent permitted by applicable law, any right each terms and conditions or the transactions contemplated hereby (whether based on contract, tort or any other theory). Each customer and Issue hereto a) certifies that no representative, agent of attorney of any other person has represented, expressly or otherwise, that such other person would not, in the event of litigation, seek to enforce the foregoing waiver and b) acknowledges that they have been induced to enter into these terms and conditions by, among other things, the mutual waivers and certifications in this section.<br /><br /> <strong>Class Action Waiver</strong><br /> The parties agree that the arbitration of any Dispute shall be conducted on an individual basis, not a class-wide basis, and that no arbitration proceedings may be consolidated with any other arbitration or other legal proceeding involving Issuer or any other person. Customer further agrees not to be a class representative, class member, or otherwise participate in a class, representative, or consolidated proceeding against Issuer for any Dispute. The parties agree that the arbitrator of any Dispute between the parties shall not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding.<br /><br /> <strong>Dispute</strong><br /> The term “Dispute” in this Arbitration Agreement and Class Action Waiver means any dispute , claim or controversy between customer and Issuer regarding any aspect of the relationship established between the parties by the Gift Card and these terms and conditions, whether based in contract, statute, regulations, ordinance, tort or any other legal, statutory or equitable theory, and included the validity, enforceability or scope of the terms and conditions except for the scope, enforceability and interpretation of this Arbitration Agreement and Class Action Waiver. Dispute shall not include any claim that all or part of the Class Action Waiver is invalid, unenforceable, unconscionable, void or voidable. Such claim may be determined only by a court of competent jurisdiction and not by an arbitrator.<br /><br /> <strong>Expiration</strong><br /> The Gift Cards do not expire, provided however, that after a number of years of inactivity, as provided by applicable unclaimed property laws, the Gift Card may be deemed abandoned property pursuant to applicable law and may be escheated to the competent authority, if required by applicable unclaimed funds law. Sales Tax does not apply to the amount paid at the time the balance is loaded on the Gift Card, however sales taxes may apply to purchases of products made by using the Gift Card, to the extent applicable.<br /><br /> <strong>Applicable Law</strong><br /> These terms and conditions, disclosures and use of the Gift Card are governed by the laws of the State of New York. With respect to international sales, the parties agree that the United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms and conditions. Except as provided above as to those Disputes submitted to arbitration pursuant to the Federal Arbitration Act, any other dispute must be brought in state or federal; court in New York City, and by purchasing a Gift Card, customer expressly submit to the jurisdiction of such courts and waive any claims that such courts are an inconvenient forum.
