PURCHASE OF A GIFT CARD
HOGAN brand gift cards are issued by Tod's S.p.A. (the “Issuer”), in paper and/or electronic form according to the organisational procedures and payment methods in place at the Issuer at the time of purchase (the “Gift Cards”). The amount of the Gift Cards shall be indicated from time to time by the Issuer and up to the maximum amount as provided for by law and the Issuer policies, as communicated at the time of purchase . Gift Cards can be used for the purchase of Hogan branded products:
- at Hogan boutiques owned by Tod's S.p.A. or by other Tod's Group Companies (the “Boutiques”), in electronic or paper form. The updated list of Boutiques where Gift Cards can be purchased can be found here https://www.hogan.com/slnk/gift-card-shops-euro ; or
- online (in electronic form only) on Hogan website (the “Website”).

In case of purchase of a Gift Card on the Website, the purchaser, as a consumer pursuant to Legislative Decree no. 206/2005, may exercise the right of withdrawal within 14 (fourteen) days from the purchase of the Gift Card. Upon receipt of the notice of withdrawal and verification of the non-use of the Gift Card, the Issuer shall refund the amount paid for the purchase of the Gift Card as soon as possible and, in any event, within fourteen (14) days from the date on which the Issuer has become aware of the withdrawal. The refund will be made with the same payment method used for the purchase of the Gift Card.
As soon as the Issuer receives the notice of withdrawal by the purchaser, upon verification that the card Gift Card has never been used, an e-mail shall be sent to the purchaser confirming that, upon exercise of the right of withdrawal, the card Gift Card is no longer usable.
The right of withdrawal is expressly excluded in the event of use (including partial) of the Gift Card.
The right of withdrawal may only be exercised in relation to Gift Cards purchased on the Website and exclusively in accordance with the procedures set out above; under no circumstances may Boutiques accept returns of Gift Cards, regardless of the channel of purchase.

USE OF A GIFT CARD
Gift Cards may only be used:
• on the Website with deliveries in (unless otherwise indicated therein): Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Poland, Portugal, Romania, Slovakia, Slovenia, Sweden,
• in any of the Boutiques listed here https://www.hogan.com/slnk/gift-card-shops-euro.
After use, any remaining Gift Card credit will remain available for subsequent purchases and cannot be redeemed or converted into cash or used to purchase another gift card.

All purchases on the Website made with a Gift Card imply acceptance of the terms and conditions of sale for online purchases. By making a purchase on the Website, the user acknowledges having carefully read such terms and conditions of sale https://www.hogan.com/slnk/legal-area/terms-and-conditions-of-sale/ and undertakes to fully comply with them.

EXPIRATION
The Gift Card shall be valid for a period of 60 months from its issue date, as resulting from the date of purchase in the Boutique or, if purchased on the Website, from the date of receipt of the Gift Card by email.
Upon expiration of the validity period, the Gift Card cannot be renewed or used for the purchase of items and the remaining value is non-refundable.
The remaining Gift Card value can be verified from time to time:
• at the Boutique cash desk;
• on the Website by accessing https://www.hogan.com/slnk/gift-card-balance/.

OTHER PAYMENT METHODS
The total order value of products purchased on the Website or in Boutique with a Gift Card includes (i) the price of the products, (ii) value added tax, if applicable, and (iii) delivery costs, if applicable. If the order exceeds the available balance on the Gift Card, the remaining amount must be paid via another accepted payment method.
In the event of purchases on the Website partially paid by Gift Card and partially by credit card or PayPal, the balance of the Gift Card shall be immediately reduced, while no amount shall be debited from the credit card or PayPal account until delivery of the products.

REFUNDS FOR PURCHASES MADE BY MEANS OF GIFT CARDS
In case of return of a product originally purchased on the Website with a Gift Card, the online return conditions [https://www.hogan.com/slnk/legal-area/terms-and-conditions-of-sale/] will be applied and the refund will be credited to the original Gift Card. In the event of the return of a product originally purchased using more than one payment method, the refund will first be made according to the payment method used for the original transaction (e.g. credit card, debit card, PayPal account) up to the amount originally paid with that payment method; then, the remaining balance of the refund due will be transferred to the Gift Card used.

STOLEN, LOST OR DAMAGED GIFT CARDS
The Gift Card is not nominative and can be used for the purchase of products by anyone in possession of it. The holder of the Gift Card is solely responsible for its use and safekeeping.
In the event of theft, loss or damage, the Gift Card shall not be replaced nor shall the Issuer be liable for any loss of the available balance on the Gift Card due to theft or fraud.
The Issuer reserves the right to reject, cancel or suspend Gift Cards and orders, if deemed necessary (e.g. in case of suspected fraud) or for other violations of the Gift Card Policy.

LIMITATION OF LIABILITY
Should the card Gift Card be issued in electronic form, the Issuer shall not be liable for the non-receipt or delay in the receipt of the card Gift Card by the addressee due to force majeure and in any event not attributable in any way to the Issuer, including, without limitation to, (i) poor functioning or interruption of the communication lines and/or systems; (ii) delay in the transmission of information or data or loss of information or data, which may occur due to any of the causes mentioned under item (i) above; (iii) inaccuracy of the data of the Gift Card recipient provided by the purchaser; (iv) circumstance that the email sent by the Issuer is considered as spam or junk mail.

MISCELLANEOUS
The Issuer reserves the right to change the format of the Gift Card at any time and, in such case, shall replace the issued and valid Gift Cards, if necessary.

If the Issuer believes that an administrative, billing or accounting error has occurred, the Issuer reserves the right to rectify the balance on the Gift Card. In case of questions regarding the transaction history or corrections, or if you wish to dispute a transaction or a correction made to the Gift Card, or for any other complaints, please contact the Customer Service via https://www.hogan.com/slnk/contact/ .

The Gift Card may not be used for advertising purposes or promotion of the marketed products or services by third parties outside the Issuer, except with the Issuer's express prior consent.

The Gift Card merely enables a mode of payment and is in no way intended as an investment instrument and/or a solicitation of savings.

The purchase and use of the Gift Card implies acceptance of these terms and conditions. The Issuer retains the right to modify and/or amend these terms and conditions at its own discretion and at any time.

Nothing in these terms and conditions of use shall be construed to limit in any way the consumer's mandatory rights under the law of the country of habitual residence, and the Issuer does not exclude any obligation or liability it is obliged to accept by law.

Any dispute relating to the use of the Gift Card shall be governed by the laws of Italy. Any dispute relating to the application, performance and interpretation of these terms and conditions of use shall be settled by the courts of the place where the user has his/her residence or has elected domicile.
